Here’s one crisis that Lindsay Lohan can scratch off her list.

The Riverside County District Attorney decided Tuesday not to prosecute Lohan for assaulting a Betty Ford Center employee in a Dec. 12 scuffle.

“We are not filing any charges in the Lindsay Lohan case due to insufficient evidence,” DA spokesman John Hall tells PEOPLE.

Lohan 24, allegedly threw a phone at Dawn Holland and yanked another phone out of her hand after the employee accused Lohan of getting drunk and returning to the rehab facility past curfew.

The DA’s office reviewed a local sheriff’s report and conducted its own investigation at its own pace.

“It wasn’t looked at any differently than other cases, and we didn’t put any special priority on this,” Hall says. “We also had to re-interview subsequent times several witnesses in the case.”

Lohan’s legal problems are far from over.

She still appears to be headed to trial over a felony grand theft accusation involving a necklace she allegedly swiped from a Venice, Calif., jeweler. A preliminary hearing is scheduled for April 22.

Lindsay Lohan just can’t catch a break these days.

Lindsay won’t be pleading guilty for allegedly stealing a $2,500 necklace from a Venice Beach jewelers, but is due back in court on April 22nd for a preliminary hearing.

Lindsay’s attorney Shawn Holley formally notified the District Attorney and Judge Keith Schwartz on Wednesday that her client would not accept the plea deal, and is ready to go to trial.

“She was never going to plead guilty to a crime she didn’t commit,” Dina told Radaronline. “All along Lindsay has never wavered regarding her innocence.”

Meanwhile, police are reigniting their investigation into allegations Lindsay attacked a Betty Ford staffer back in December.

According to TMZ, in the last two days, the Riverside County District Attorney’s Office sent investigators to meet with key witnesses who were with Lindsay on December 12, 2010 — the night she allegedly got into an altercation with Dawn Holland.

Investigators wanted to know if the witness could testify if it was Lindsay or Dawn who was the “aggressor” during the fight.

They also want to know if the witnesses will testify against Lindsay is she goes to trial. Basically: Lindsay is screwed.

Lindsay Lohan has a secret plan to stay out of jail if Judge Stephanie Sauntner rules that she violated her probation for getting charged with felony grand theft, RadarOnline.com is exclusively reporting.

A source close to Lohan reveals: “Lindsay is taking a HUGE gamble by proceeding forward with the case. Her preliminary hearing is set for April 22, 2011. At the conclusion of the preliminary hearing, Judge Sautner will determine if there is enough evidence to proceed with a trial against Lindsay and if Lindsay violated terms of her probation.

“If Judge Sautner decides to proceed with the criminal trial, Lindsay will automatically be found in violation of her probation. Judge Sautner ROUTINELY remands repeat offenders on probation violation upon determining that a violation occurred. If Judge Sautner determines that Lindsay violated her probation, Lindsay’s attorney, Shawn Holley, will ask that Lindsay not be remanded into custody.

“Holley will ask Sautner to delay sentencing for Lindsay, and ask that she be allowed to stay out on bail pending her trial. She will argue that if Lindsay is found guilty at trial, then Sautner can tag that jail time onto Lindsay’s sentence. Lindsay and Shawn are confident, that once the defense is presented, Judge Sautner will realize that the store owners of the jewelry store are lacking credibility, and that Lindsay in no way stole that necklace, period.”

A source in the DA’s office tells RadarOnline.com: “Judge Sautner will most likely order Lindsay into custody immediately if she is ordered to stand trial and she finds that she violated her probation. The DA would likely only ask for six months in county jail for the probation violation but, Judge Sautner could go above and beyond that.

“Judge Sautner is very, very tough. Yes, she is fair, but when dealing with repeat offenders, she shows no mercy. Judge Sautner is known for being a pro-prosecution judge.”

Lindsay’s attorney released a statement to RadarOnline.com yesterday, proclaiming her client’s innocence: “Ms. Lohan has maintained her innocence from the moment this case was filed and she has never wavered. Though many advised her to follow the safe route by taking ‘the deal’, the truth is, Ms. Lohan is innocent; she has a strong defense; and we are confident that a jury will listen to the evidence fairly and acquit her.”

When you hear the name “Lindsay,” do you immediately think of the tabloid target and sometime-actress, or your co-worker/sister/friend who happens to have the same name?

“Lindsay” is a common moniker among young American women, and we know at least 20 Lindsays dating back from kindergarten; even so, Lindsay Lohan — inarguably the most famous of them all — is banking on being the one and only.

“Lindsay is dropping the Lohan and just going by Lindsay. Plus, me and (younger daughter) Ali will be officially changing our last names back to my maiden name, Sullivan,” a dead serious Dina Lohan tells Popeater.

Apparently, the court-going star had been on the fence about dropping “Lohan” until the E-trade Super Bowl commercial in which a baby was referred to as “that milkaholic Lindsay.”

Talk about name recognition. That being said, “Lindsay” does not have the same unique power as “Oprah,” “Madonna,” “Cher” or “Beyonce.” Then again, only a handful of people around the world can say, “Hi, my name is Beyonce.”

“Now you can add Lindsay to that list,” says a Lohan pal. “And it’s a way for them all to start over. No one in the family wants anything to do with Lindsay’s father (Michael Lohan) anymore and that includes sharing a last name.”

We can’t argue with that. As you might recall, Papa Lohan — no stranger to brushes with the law — was arrested for striking ex-girlfriend Kate Major.

Meanwhile, Lohan herself might want some distance from her own infamous problems: the former “Mean Girls” phenom, now virtually unhirable in Hollywood, will soon stand trial for felony grand theft after rejecting a plea deal that involved jail time.

If Lohan — excuse us, Lindsay — removes her notorious last name, she’ll erase some family heritage dating back to County Cork in Ireland.

Still, it will haunt her forever: The Internet has a long memory, and “Lohan” headlines stretch back some seven years. We feel worse for the all the world’s Lindsays whose identities will practically be stolen by an alleged celebrity jewelry thief.
